1. ABOUT THIS POLICY

1.1This Privacy Policy explains how Maker Media Pty Ltd (ABN 90 670 674 138) of 4 Towns Street, Gladesville NSW 2111 (we, us or the Promoter) collects, uses, discloses and protects personal information in connection with the Budget Battlers Competition (the Promotion), which is promoted during broadcasts of Budget Battlers on Channel 9 and 9Now.

1.2We are bound by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles. This Privacy Policy should be read together with the Promotion’s Terms and Conditions (Terms). Capitalised terms not defined here have the meaning given in the Terms.

1.3By registering for the Promotion, you acknowledge that you have read this Privacy Policy and agree to your personal information being handled as described in it.

2. WHAT PERSONAL INFORMATION WE COLLECT

2.1When you register for the Promotion, we collect:

(a)your full name, email address, home address (including the address of the property proposed for any RESINC installation, if different), mobile phone number, date of birth and gender;

(b)your answer to the Entry Question; and

(c)your agreement to receive Maker Media marketing communications (a condition of entry) and your separate choice about receiving exclusive offers directly from our partners (optional).

2.2If you are shortlisted, selected as a winner or identified as a reserve entrant, we may also collect proof of identity, age and residency, a signed prize acceptance and release form, delivery details, and information reasonably necessary to assess supplier-specific prize eligibility and fulfilment. This may include the nominated RESINC installation property address, property and site details, permissions and suitability information, or vehicle-rental eligibility details. If you agree to participate in publicity, filming or photography, we may collect your image, voice and likeness and relevant location and participant releases.

2.3When you visit www.budgetbattlers.com, we and our website service providers may automatically collect technical information such as your IP address, device and browser type, and pages visited, including through cookies and similar technologies.

2.4We also keep records of any communications you have with us about the Promotion, such as enquiries or complaints.

3. SENSITIVE INFORMATION IN YOUR ENTRY

3.1The Entry Question asks you to tell us why you deserve to win. You do not need to share sensitive information, such as information about your health, disability, religion, ethnicity or sexuality, to enter or to win.

3.2If you choose to include sensitive information about yourself in your entry, you consent to us collecting it and using it to judge your entry. We will not disclose sensitive information to Partners for marketing purposes, and we will not publish sensitive information or use it in publicity without first obtaining your separate, express consent. The Terms provide for a licence to use entry material for Promotion-related purposes, subject to applicable privacy law.

3.3Please do not include personal information about other people (for example, family members) in your entry unless they have agreed to it.

4. HOW WE COLLECT PERSONAL INFORMATION

4.1We collect personal information directly from you, through the registration form at www.budgetbattlers.com, by email or phone, and through any forms you complete if you win. We may also collect technical information automatically when you use the website, as described in clause 2.3.

4.2The Promotion is only open to Australian residents aged 18 years or over. If we become aware that we have collected personal information from a person under 18, we will delete it.

5. WHY WE COLLECT AND USE PERSONAL INFORMATION

5.1We collect, hold and use your personal information to:

(a)conduct and administer the Promotion, including verifying your eligibility and preventing invalid, duplicate, automated or fraudulent entries;

(b)judge entries;

(c)contact and assess shortlisted entrants, winners and reserve entrants; verify supplier-specific eligibility (including RESINC property suitability); and award, arrange and deliver prizes;

(d)contact winners and publish winner details in accordance with the Terms, including publicity using a winner’s name, image, voice, state of residence and entry where applicable;

(e)arrange agreed filming, photography or other promotional activities at a winner’s home, including prize delivery or installation, subject to agreed access arrangements and applicable releases;

(f)disclose your name, email address and mobile phone number to the Partners, if you opt in (see clause 7);

(g)send you marketing communications from the Promoter as agreed when entering, subject to your right to unsubscribe;

(h)respond to enquiries and complaints; and

(i)comply with our legal obligations, including requirements of State and Territory regulators.

5.2Entries are assessed by two appointed judges against the criteria and scoring and tie-break procedures in clause 5 of the Terms. We may keep judging scores, ranking, tie-break results, prize allocations and reserve lists to administer the Promotion and resolve eligibility or prize-allocation issues. We do not use automated decision-making (including artificial intelligence) to decide winners. Entries are considered for weekly prizes and, subject to the Terms, the two Series Prizes.

5.3If you do not provide the personal information requested on the registration form, you will not be able to register for the Promotion. If a winner does not provide information reasonably required to verify eligibility or fulfil the prize (including information requested under clause 2.2), they may forfeit their prize under the Terms.

6. WHO WE DISCLOSE PERSONAL INFORMATION TO

6.1We may disclose your personal information, for the purposes set out in clause 5, to:

(a)Nine Network Australia Pty Ltd (ABN 88 008 685 407), as broadcaster of Budget Battlers;

(b)the judges of the Promotion;

(c)prize suppliers (including TradieSpec, Storage King, She Sells, Stick on Tiles Australia, Timtek and RESINC Solar and Batteries) and their authorised representatives, only where reasonably necessary to verify eligibility, assess prize suitability, arrange fulfilment or supply prizes, subject to applicable supplier-specific prize terms;

(d)our service providers, such as website, hosting, data storage, email, SMS and courier providers, who are required to handle it only for the purposes for which we engage them;

(e)our professional advisers, such as lawyers and auditors;

(f)State and Territory regulators, government authorities and law enforcement agencies, where required or authorised by law; and

(g)the Partners listed in clause 7, but only if you opt in.

6.2For RESINC prize suitability assessments, we will disclose only shortlisted entrants’ names, nominated installation property addresses and relevant property or site information to RESINC or its authorised representatives as reasonably necessary to assess eligibility, serviceability and installation suitability. This disclosure does not authorise direct marketing; marketing disclosure to RESINC requires your separate optional partner opt-in under clause 7. We do not sell your personal information.

7. PARTNER OFFERS (OPT-IN ONLY)

7.1If you tick the optional “exclusive offers from our partners” box on the registration form, we may disclose your name, email address and mobile phone number to each of the following organisations (each a Partner), so that each Partner may send you marketing communications about its products and services:

(a)TradieSpec Pty Ltd (ABN 38 629 902 576);

(b)Storage King Pty Ltd (ABN 86 079 872 281);

(c)Stick on Tiles Australia (ABN 21 685 464 466);

(d)She Sells with Brooke Pty Ltd (ABN 67 674 094 681);

(e)Timtek South Melbourne (ABN 68 702 959 019);

(f)RESINC Solar and Batteries (ABN 81 712 459 481).

7.2Opting in to Partner marketing is optional. It is not a condition of entry and has no effect on judging or your chances of winning. If you do not tick the optional box, we will not disclose your personal information to Partners for marketing purposes. Information reasonably necessary for prize eligibility, including RESINC property suitability assessment for shortlisted entrants, or prize fulfilment may still be shared with the relevant supplier under clause 6.

7.3We will disclose your details to the Partners within 60 days after the end of the relevant Entry Period. We will not disclose your entry answer, home address, separately nominated installation property address, date of birth, judging scores or property suitability information to Partners for marketing purposes. Any separate disclosure to a prize supplier for eligibility, site assessment or prize fulfilment is limited to information reasonably required for that purpose, as described in clause 6.

7.4Once disclosed, each Partner will handle your personal information in accordance with its own privacy policy, and is responsible for complying with the Privacy Act and the Spam Act 2003 (Cth) when contacting you.

7.5You can withdraw your consent to Partner marketing at any time by emailing info@budgetbattlers.com. If you withdraw before we have disclosed your details, we will not disclose them. If your details have already been disclosed, we will let you know which Partners received them, and you can opt out of their marketing using the unsubscribe function in their communications or by contacting that Partner directly.

8. DIRECT MARKETING BY US

8.1As a condition of entry, you must agree to receive direct marketing communications from the Promoter about Budget Battlers and the Promoter’s other productions by email and/or SMS. You can withdraw your consent at any time by using the unsubscribe function in our messages or by emailing info@budgetbattlers.com. If you withdraw your consent, we will stop sending you direct marketing communications, subject to any messages permitted by law. Partner marketing is separate and optional (see clause 7).

9. STORAGE, SECURITY AND RETENTION

9.1We hold personal information in electronic form using secure systems and service providers, and take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. Access is limited to people who need it to run the Promotion.

9.2We will retain personal information collected for the Promotion for up to twenty-four (24) months after the Promotional Period closes, unless a longer period is reasonably required for a lawful purpose, including to resolve disputes, respond to complaints or meet legal or regulatory obligations. We will take reasonable steps to destroy or de-identify personal information when it is no longer needed for any purpose for which it may be used or disclosed, subject to applicable legal requirements. Records relating to winners may be retained for longer where reasonably necessary to meet legal, tax, accounting or regulatory obligations.

9.3If a data breach occurs that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under the Privacy Act.

10. ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

10.1You may ask to access or correct the personal information we hold about you by contacting us using the details in clause 13. We will respond within a reasonable period, usually within 30 days. We may need to verify your identity before doing so. If we refuse your request, we will tell you why in writing and how you can complain.

11. COMPLAINTS

11.1If you have a concern about how we have handled your personal information, please contact us using the details in clause 13. We will acknowledge your complaint and aim to respond within 30 days.

11.2If you are not satisfied with our response, you may complain to the OAIC at www.oaic.gov.au or by calling 1300 363 992.

12. CHANGES TO THIS POLICY

12.1We may update this Privacy Policy from time to time. The current version will be available at www.budgetbattlers.com. We will not use or disclose personal information already collected in a materially different way without your consent, unless permitted or required by law.
